Merlin AI Mobile Application Terms and Conditions
1. Acceptance of Terms. By downloading and/or using the Merlin AI app (the “App”), created by Dogtown Media LLC (“Developer”) you agree to be bound by these Terms and Conditions (the “Terms”). Merlin AI reserves the right to change or modify the Terms at any time, with or without notice, and your continued use of the App constitutes your acceptance of any such changes or modifications.
2. License. Merlin AI grants you a limited, non-exclusive, revocable, non-transferable license to use the App, solely for your own personal, non-commercial use.
3. User Content. Merlin AI may allow you to submit content in the form of text, images, audio, video, or other material (“User Content”). You are solely responsible for any User Content that you submit, including its accuracy, legality, and appropriateness. By submitting User Content, you grant Merlin AI a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
4. Prohibited Uses. You shall not use the App for any illegal or unauthorized purpose, or in any way that could damage, disable, overburden, or impair the App. You shall not use the App to transmit any worms, viruses, or any malicious code. You shall not use the App to collect or store personal data about other App users.
5. Indemnification. You agree to indemnify and hold harmless Merlin AI and Developer, its officers, directors, employees, and agents, from any and all claims and expenses, including attorneys’ fees, arising out of or related to your use of the App or any violation of these Terms.
6. Disclaimer. The App is provided “as is” and “as available”, without warranties of any kind, either express or implied. You agree that your use of the App is at your sole risk.
7. Limitation of Liability. Under no circumstances shall Merlin AI be liable for any direct, indirect, special, incidental, or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the App, even if Developer and Merlin AI has been advised of the possibility of such damages.
8. App Store. The App Store has no obligation to furnish any maintenance or support services with respect to the App.
